Art. 1 — Subject matter of the Service
showlab is a SaaS platform that allows professional users in the fashion industry to generate photographic content through third-party generative AI providers (including Google Gemini, OpenAI and Kling). The Service includes the creation, storage and download of the content generated in the available modes (AI Shoot, Campaign Set, Outfit Set, Video AI, Marketplace Optimizer, Caption, Recolor, Inspiration, Sale Cards, Post-prod).
Art. 1-bis — Scope (Consumer and Professional User)
The Service is primarily aimed at fashion industry operators. For the purposes of these Terms, "Consumer User" means the natural person acting for purposes outside any business, commercial, craft or professional activity (art. 3 of the Italian Consumer Code), and "Professional User" means anyone acting in the exercise of their own activity.
The mandatory protections afforded to Consumers — in particular the right of withdrawal (art. 4) and the consumer's court of jurisdiction (art. 17) — apply exclusively to the Consumer User. These Terms apply to the Professional User excluding the provisions reserved for consumers.
Art. 2 — Account and access
Access to the Service requires the creation of a personal Account with a valid email address. The User is responsible for keeping their credentials confidential. Sharing the same Account between several people and the unauthorised resale of Credits or generated content are prohibited.
The Service is reserved for adults: by creating an Account the User declares to be at least 18 years old and, if a Professional User, to be acting within their own activity. Registration by minors is prohibited.
Art. 3 — Plans, prices and credits
The Service is offered in monthly plans: Start (free), Boost (€39/month), Ultra (€99/month), Legend (€199/month), Business (on request).
Each plan includes a monthly allocation of photo Credits and video Credits. Credits not used within the period do NOT carry over to the following period and are reset upon renewal. The video pool is a separate counter from the photo pool.
The prices shown are inclusive of VAT: the amount displayed is what you pay, with no additions at checkout. VAT is itemised on the invoice at the statutory rate. Billing is handled through Stripe; payment details are NEVER stored directly by showlab.
Art. 3-bis — Term, automatic renewal and cancellation
Paid subscriptions run for an indefinite term and renew automatically at the end of each monthly period, charging the then-current fee to the registered payment method, until cancelled.
The User may cancel at any time from the subscription management area (Stripe portal): cancellation takes effect at the end of the period already paid for, during which the Service remains active. No refunds are provided for periods already invoiced, save as provided in art. 4.
Art. 4 — Right of withdrawal for digital services (art. 59 Italian Consumer Code)
As this is a digital Service, the Consumer User has the right to withdraw within 14 days of subscribing. At checkout the User expressly consents to the immediate performance of the Service and acknowledges, pursuant to art. 59(1)(o) of the Italian Consumer Code, that using even a single Credit causes the right of withdrawal to lapse. Therefore:
- if within 14 days of subscribing the Consumer User has used no Credit, they may withdraw and obtain a full refund of the amount paid;
- if they have used even a single Credit, the right of withdrawal is lost and no refund of the fee already paid is provided.
To try the Service without any payment, the free Start plan is always available. A withdrawal request may be sent to info@showlab.ai or made from the subscription management area; the refund, where due, is made using the same payment method within 14 days.
Art. 5 — AI Act marking of generated content
In compliance with EU Regulation 2024/1689 (AI Act), the generated Outputs are marked as content produced by artificial intelligence. Every image and every video downloaded in the supported formats (JPEG, PNG, MP4/MOV) includes a machine-readable marker in the file metadata (IPTC standard «Digital Source Type: trainedAlgorithmicMedia», embedded as an XMP packet), in addition to being recorded in the showlab database. This marking allows platforms, search engines and verification tools to automatically recognise the artificial origin of the content. showlab reserves the right to adopt further standards in future (e.g. C2PA signing), giving the User prior notice.
The marking described above is a technical (machine-readable) measure provided by showlab. Where the User who publishes or distributes the Outputs qualifies as a "deployer" within the meaning of art. 50(4) of EU Regulation 2024/1689, that User remains responsible — from 2 August 2026 — for applying a clear and visible disclosure whenever the Output constitutes a "deep fake", that is an image or video depicting persons (including synthetic ones), objects or scenes in a way that appears authentic. showlab provides the technical marking tools; compliance with the visible transparency obligation at the time of publication remains the User's responsibility.
Art. 6 — Credit quota and generation block
When the Credits for the period run out, the creation of new content is suspended until renewal or a plan upgrade. Content already generated remains accessible in the Library without any restriction on consultation.
Art. 7 — Storage Limits of the personal Library
7.1 Each Account has a personal library (the "Library") in which the following are stored:
- the images and other content uploaded by the User ("Uploads");
- the outputs generated by the AI following the User's requests ("Generations").
7.2 The Library is subject to a maximum number of items (the "Storage Limit") which varies according to the plan subscribed:

7.3 The Storage Limit includes both Uploads and successful Generations. Failed Generations, Generations in error or queued are *not* counted.
7.4 When the User reaches the Storage Limit of their plan, the Service automatically suspends the creation of new Generations and the upload of new Uploads until the User frees up space by: (a) manually deleting items from their Library; (b) upgrading to a higher plan with a larger Storage Limit.
7.5 Once 80% of the Storage Limit is exceeded, the User receives a visual notice in the Library area, so as to allow them to plan deletion or a plan upgrade independently.
7.6 Deleting an item from the Library is irreversible and entails the permanent removal of the file from showlab's systems, save for statutory retention obligations (art. 15) and security backup copies, which are subject to the normal rotation cycle.
7.7 showlab reserves the right to change the Storage Limits with at least 30 (thirty) days' notice, sent to the User's email address, without prejudice to the User's right to withdraw pursuant to art. 4 of these Terms in the event of changes to their detriment.
7.8 Any Generations in progress at the time the Storage Limit is reached are nevertheless completed and saved in the Library; it will subsequently be the User's responsibility to free up space before requesting new Generations.
Art. 8 — Permitted use and User content
The User warrants that they hold all necessary rights in the content they upload (product photos, logos, trade marks, images) and that they do not infringe third-party rights (intellectual property, image rights, privacy). It is prohibited to use the Service to generate unlawful, defamatory or misleading content, content depicting real people without their consent, or content infringing third-party trade marks and copyright. The User is solely responsible for the content uploaded and for the use they make of the Outputs.
Art. 9 — Ownership of generated content
To the extent permitted by law, the content generated by the User through the Service (the "Outputs") belongs to the User, who may use it freely, including for commercial purposes, with no watermark and no royalties payable to showlab. showlab claims no copyright over the Outputs. Third-party rights in the trade marks and products depicted, and the User's responsibility under art. 8, remain unaffected. showlab retains the Outputs for the provision of the Service (Library) and does NOT use them to train AI models. Given their algorithmic origin, showlab does not warrant that individual Outputs are independently protectable as works of authorship: their protectability depends on the human creative contribution and on the applicable law.
Art. 10 — Nature of the AI Service, no warranties and availability
The Outputs are generated by artificial intelligence models and provided "as is". showlab does not warrant that the Outputs are free from errors, accurate, fit for a specific purpose or free from unintended similarities: it is the User's responsibility to check every Output before use, in particular for advertising purposes. showlab undertakes to provide the best possible continuity of Service but does not offer a guaranteed service level (SLA), save for dedicated Business agreements; the Service may be suspended for maintenance, updates or causes not attributable to showlab (including malfunctions of third-party AI providers).
The statutory guarantee of conformity for digital content and services provided by arts. 135-octies et seq. of the Italian Consumer Code remains unaffected for the Consumer User, and the exclusions in this article neither intend nor are able to limit it.
Art. 11 — Limitation of liability
To the maximum extent permitted by law, showlab's total liability towards the User is limited to the amount paid by the User in the 12 months preceding the event. showlab is not liable for indirect damages, loss of profits, loss of data or loss of opportunity arising from the use or inability to use the Service or the Outputs. Nothing in these Terms excludes or limits liability that cannot be excluded by law (e.g. wilful misconduct or gross negligence).
Art. 12 — Indemnity
The User shall indemnify and hold showlab harmless from any third-party claim, cost or damage arising from: (a) the content uploaded by the User; (b) the use of the Outputs in breach of law or third-party rights; (c) the breach of these Terms.
Art. 13 — Suspension and termination
showlab may suspend or close the Account in the event of a breach of these Terms, fraudulent use, non-payment or activities that put the Service or third parties at risk, giving prior notice where possible. The User may cease using the Service at any time by deactivating the subscription; the effects of art. 4 (withdrawal) and art. 15 (retention) remain unaffected.
Art. 14 — Processing of personal data
The User's personal data is processed in accordance with EU Regulation 2016/679 (GDPR) and with the privacy notice available at the Privacy Policy page. The data controller is showlab (full details in the privacy notice).
Art. 15 — Retention and deletion
Upon termination of the subscription, content remains accessible for a period of 60 days for export purposes, after which it is permanently deleted, save for tax retention obligations and pending disputes. The User may request early deletion by writing to privacy@showlab.ai.
Art. 16 — Changes to the Terms
showlab reserves the right to amend these Terms with at least 30 days' notice by email. A User who does not accept the changes may withdraw free of charge within that period.
Art. 17 — Governing law and jurisdiction
These Terms are governed by Italian law. For any dispute arising from the use of the Service, the consumer's court of jurisdiction has jurisdiction where the User is a Consumer User; otherwise the court of Santa Maria Capua Vetere has exclusive jurisdiction (the Provider's registered office).
Art. 17-bis — Complaints and dispute resolution (ADR)
For any complaint the User may write to info@showlab.ai and showlab undertakes to reply and to seek an amicable solution. The Consumer User may also use the alternative dispute resolution (ADR) bodies accredited under Part V, Title II-bis of the Italian Consumer Code. Recourse to ADR is optional and does not affect the right to bring proceedings before the competent court pursuant to art. 17.
Art. 18 — Specific approval of clauses
Pursuant to and for the purposes of arts. 1341 and 1342 of the Italian Civil Code, the User declares that they have read and specifically approve the following clauses: art. 4 (lapse of the right of withdrawal upon use of Credits), art. 10 (no warranties and no SLA), art. 11 (limitation of liability), art. 12 (indemnity), art. 13 (suspension and termination of the Account), art. 7.6 (irreversibility of deletion), art. 16 (unilateral changes to the Terms) and art. 17 (court of jurisdiction for the Professional User). For the Consumer User, the mandatory statutory protections and the possible ineffectiveness of unfair terms pursuant to arts. 33 et seq. of the Italian Consumer Code remain unaffected.
